But if the national commissioner of correctional services is “empowered by law to do so,” the SCA stated, the commissioner may take into account the time the inmate has already spent on medical parole that was unlawfully granted.
Zuma still has the option to file an appeal with the Constitutional Court, which would halt the order.
The high court’s ruling that the former president’s time on medical parole should not be included in the calculation of his sentence was set aside by the SCA on Monday.
But the appeal court said by setting this declaratory, the effect was that “once the order in this appeal is handed down, Mr Zuma’s position as it was prior to his release on medical parole will be reinstated”.
In other words, Mr Zuma in law has not finished serving his sentence.
He must return to the Estcourt Correctional Centre to do so.
”The ConCourt sentenced Zuma to 15 months in prison for contempt after he refused to obey its directive to respond to the state capture commission’s lawful summons.
He was given medical parole by Arthur Fraser, the former national commissioner of correctional services, after serving less than two months.
The DA, Helen Suzman Foundation, and AfriForum immediately appealed the decision to the high court.
Their application was successful.
